Trump's move to end DACA program blocked by second U.S. judge

Second judge blocks Trump from ending DACA

Just days before the Supreme Court is to consider getting involved in the deepening controversy over the legal fate of almost 700,000 undocumented immigrants who have grown up in this country, a second federal judge has ordered the Trump Administration not to end next month their protection against deportation.

Judge Nicholas Garaufis, a former President Bill Clinton appointee on the U.S. District Court for the Eastern District of NY, concluded the government violated the Administrative Procedure Act (APA) when it ended the program.

U.S. Department of Justice attorneys have attempted to argue in the U.S. District Court for the Eastern District of NY about an ongoing "litigation risk" as justification for the government's decision.

This is the second time that a federal judge has ruled against the administration's decision to end DACA, which affects some 700,000 people in the US often referred to as "Dreamers". Supreme Court agreed to hear the Trump administration's appeal of Alsup's ruling at its conference on Friday.

In one area, this new GOP DACA bill runs directly against Mr. Trump's 2019 budget issued on Monday, which sought to eliminate the State Criminal Alien Assistance Program - that popular program funnels money to states to deal with the cost of holding illegal immigrants in prison. The issues surrounding DACA began with President Donald Trump calling for an end to the program in September after claiming it to be an unconstitutional use of an executive order.

The new GOP plan also includes a number of restrictions on federal judges, to keep them from overturning decisions made by immigration officials on visa revocations, naturalization applications, as well as other specific immigration decisions by the Secretary of Homeland Security.

"I said we would have an open and fair process", Senate Majority Leader Mitch McConnell told reporters on Tuesday. The biggest difference between then and now is that the Democrats have forfeited their best leverage to force Republicans to deal. Amendments gaining 60 votes would become part of the broader immigration bill.

Tuesday's ruling comes as the fate of the DACA recipients is being debated in the Senate. John McCain, R-Ariz., and Chris Coons, D-Del. However, the reasons it gave a year ago for winding down the program were too arbitrary and could not stand, the judge said.

Average age of DREAMers when they first entered the U.S. "We ought to just get started".

Still, many Republicans are insisting that the bill incorporating Trump's priorities is a compromise. Nonetheless, a group of Republican senators on Sunday evening announced their intention to offer the president's framework as legislation during the immigration debate. Apart from Grassley, the Bill has been co-sponsored by Senators John Cornyn, Thom Tillis, David Perdue, James Lankford, Tom Cotton and Joni Ernst. Many Democrats consider some of the proposals, including limiting the relatives that legal immigrants can bring to the U.S., to be non-starters.
