Mississippi's New Abortion Law Is The Most Restrictive In The Nation

Mississippi bans abortions at 15 weeks, earliest in the nation

The Associated Press reports Mississippi's only abortion clinic, the Women's Health Organization in Jackson, filed for the temporary restraining order 24 hours after the bill was signed into law.

Just one day after Mississippi's governor signed a law banning abortions after 15 weeks, a federal judge issued an order temporarily blocking it. Today, U.S. District Judge Carlton Reeves put a temporary restraining order on the law Tuesday.

In the suit, World Health Organization abortionist Dr. Sacheen Carr-Ellis says that women seeking abortions should be able to "make the decision that is best for her about the course of her pregnancy, based on her own values and goals for her life", and that the law's impact would start immediately by forcing the cancellation of an abortion scheduled for this afternoon.

It becomes law immediately and bans most abortions after 15 weeks' gestation.

He said he expected a swift legal challenge, and indeed, the abortion clinic, the Jackson Women's Health Organisation, filed a complaint in the US District Court for Mississippi's Southern District less than an hour after he signed the bill into law.

MS passed the law after the U.S. Senate rejected a measure that would have banned abortion after 20 weeks.

The case was brought by the Jackson Women's Health Organization, the only remaining abortion clinic in MS, and Dr. Sacheen Carr-Ellis, who practices there. Current federal law blocks such restrictions by states.

"That right protects her choice "to have an abortion before viability.' States can not 'prohibit any woman from making the ultimate decision" to do so". Bryant has frequently said he wants MS to be the "safest place in America for an unborn child".

Derzis said she was "delighted" Reeves temporarily blocked the law. Bryant calls Reeves' ruling "disappointing".

A federal judge in MS will hear arguments Tuesday over whether he should block the nation's most restrictive abortion law less than 24 hours after it took effect.

Anti-abortion activists and legislatures often push restrictive new legislation with the understanding that they will face legal challenges in the hopes of taking those cases to the Supreme Court, where they could have a chance at chipping away at national abortion policy.

A federal judge has heard arguments from attorneys seeking and opposing an order that would temporarily block a new MS law banning abortions after 15 weeks' gestation.

Special assistant attorney general Paul Barnes argued the state has an interest in protecting maternal health and "unborn life". "States can not "prohibit any woman from making the ultimate decision" to do so".

The suit says the clinic performed 78 abortions in 2017 when the fetus was identified as being 15 weeks or older. That's out of about 2,500 abortions performed statewide, mostly at the clinic. Pregnancies resulting from rape and incest aren't exempted.

Mississippi, a relatively poor state, has the highest infant mortality rate and worst overall ranking in the nation for children and infant care, according to the 2018 Health of Women and Children report published earlier this month by America's Health Rankings, which has been publishing an annual state-by-state assessment for almost 30 years, according to Newsweek.
