Trump’s Attorney Drops Evidentiary Bombshell on Michael Avenatti

Investigators to review more than 1 million items seized from Cohen

Attorneys for President Donald Trump's personal lawyer, Michael Cohen, are headed to federal court Wednesday to try and block Michael Avenatti - the lawyer for porn actress Stormy Daniels - from intervening in the federal investigation into Cohen.

But he withdrew the request after a court hearing Wednesday in NY in which a judge told him that while he is free to speak out now, he would have to end his "publicity tour on TV and elsewhere" if he entered the case.

The judge said she is anxious that Avenatti's "denigrating Mr. Cohen" could deprive him of a fair trial if he is criminally charged by the feds, who are looking into his business dealings, including a $130,000 "hush money" payment to Avenatti's porn star client, who claims she had a fling with the President.

In the same interview, Avenatti also alleged Trump is among the people on the recordings.

"Special master" Barbara Jones was appointed by the U.S. District Court to review the files and render a verdict on Cohen and Trump's claim that they were protected by attorney-client privilege. Daniels, whose real name is Stephanie Clifford, has also filed a suit against Cohen, claiming a nondisclosure agreement she struck with Trump is null and void. Nor would he be able to publicly "degenerate Mr. Cohen".

Ryan's first point of concern remains Avenatti's role in the release of information about a bank account used by Cohen to allegedly pay Clifford $130,000 in hush-money ahead of the 2016 presidential election. They also said it was likely that they belonged to Cohen's wife, which surprised federal prosecutors from the United States attorney's office, who said that they were not previously made aware of that information. McDermott Will & Emery partner Todd Harrison told the court that Cohen's team had so far received 3.7 million files from the government. The judge ruled Wednesday that Cohen's attorneys' review of the materials must be concluded by June 15, or the remaining materials will be sent to a group of lawyers not connected to the case.

Cohen, who has not been charged with a crime, is under investigation on suspicion of campaign-finance violations and bank fraud.

Additional electronic data from the contents of other telephones and digital devices were produced by the government for study by Jones and lawyers for Cohen and Trump on May 11, and Jones said the three telephones that produced the more than million pieces of data were from that shipment.

"I don't want you to have some existence in a limbo, where you are free to denigrate Mr. Cohen and I believe potentially deprive him of a fair trial by tainting a jury pool".

When someone, especially a lawyer, is prepared to be not straightforward, and cute, and I would say misleading, with the court, on the tiniest of matters, it raises a serious question about how that person-how that lawyer-will conduct themselves on the more serious matters.
She said the material includes data from a video recorder.

"We did not do anything improper, and in any event that has nothing to do with this proceeding", Avenatti said. Cohen and Trump both argued that their attorneys should get to review the materials to see what is privileged before investigators get them.

That triggered back-and-forth allegations of misconduct in court filings over Avenatti's request to be admitted practice in Manhattan federal court to represent Daniels - including a claim from him that Cohen leaked a recording of a conversation with Daniels' former lawyer to the media.

"We have already started producing documents to the government, so any suggestion we are not cooperating is meritless", Avenatti told the Journal.
