CNN legal analyst Jeffrey Toobin predicted on Wednesday that Supreme Court Justice Anthony Kennedy announcing his retirement and vacating a spot for President Donald Trump to fill meant Roe v. Wade, the landmark case establishing the right to abortion access, was "doomed". He proved instrumental in advancing gay rights, buttressing abortion rights and erasing political spending limits.

But a dissenting liberal justice said the court was making a historic mistake by refusing to recognize the ban discriminates against Muslims. The 81-year-old justice was appointed to the Supreme Court by President Ronald Reagan in 1988.

Although he leaned conservative in his rulings, Kennedy was thought to be the Court's swing vote.

The 5-4 ruling, with the court's five conservatives in the majority, ends a fierce fight in the courts over whether the policy represented an unlawful Muslim ban.

Justice Kennedy's own nomination to the court also leaves little doubt that the stakes of his replacement now are very real.

"The ruling will go down in history as one of the Supreme Court's great failures", said Omar Jadwat, a lawyer for the American Civil Liberties Union, which challenged the ban.

Mr Trump said he was launching an immediate search for someone to replace Justice Kennedy, whom he hailed as a spectacular man with great vision and heart. If past practice is any indication, the president will name a nominee within weeks, setting in motion a process that could allow confirmation by the time the court reconvenes in early October.

Liberals and conservatives alike can easily identify Kennedy opinions and decisive votes that they love and that they deplore - on campaign finance, abortion rights, the Second Amendment, affirmative action, gay marriage, and environmental protection, among many others.

The court legalized abortion with its decision in Roe v. Wade in 1973.

The Supreme Court judge was joined by his four conservative colleagues in voting along ideological grounds to uphold the order. "It is likely that Kennedy's successor will be more anti-choice than Kennedy was", Glenn Cohen, a Professor at Harvard Law School and an expert on medical ethics, told Business Insider.

There is, of course, a chance that Democrats and some anti-Trump Republicans are able to continually block this nominee, much like Sen.

There is one would-be justice among the federal appeals judges on Trump's shortlist who would scoop the median-voter title from Roberts, at least as measured by Judicial Common Space scores - and that's Thomas Hardiman, a judge who serves on the 3rd U.S. Circuit Court of Appeals.
