Kavanaugh to hear first arguments as Supreme Court justice

Donald Trump swears in Brett Kavanaugh, says sexual assault allegations were a 'hoax' - Donald Trump's America

Justice Brett Kavanaugh received a warm welcome from his new colleagues Tuesday as he made a low-key public debut at the Supreme Court, in a collegial scene that stood in sharp contrast to the chaos of his confirmation process.

The Senate voted to confirm Kavanaugh in a 50-48 vote on October 6, concluding a bitter confirmation battle with exactly one month left before the midterm election on November 6.

Kavanaugh denied the allegations and during a Senate hearing accused Democrats of an "orchestrated political hit".

After an extra Federal Bureau of Investigation probe - which media reports say was drastically curtailed by the White House - also found nothing new, Kavanaugh was finally voted into the coveted post.

Kavanaugh has also begun moving in to his new office at the Supreme Court, taking over space previously used by Justice Samuel Alito, who moved into offices vacated by Kennedy.

During the public swearing-in ceremony, President Donald Trump apologized to Kavanaugh and his family "for the pain and suffering you have been forced to endure".

But, he told the new justice, "You, sir, under historic scrutiny, were proven innocent".

The entirely ceremonial swearing-in, two days after he officially became a member of the high court, is unusual for new justices.

Kavanaugh was sworn in on Saturday evening in a private ceremony as protesters chanted outside the court building.

"Now they're thinking about impeaching a brilliant jurist, a man that did nothing wrong, a man that was caught up in a hoax that was set up by the Democrats using the Democrats' lawyers", Trump said.

In reality, Kavanaugh´s confirmation lit a match under existing tensions ahead of the midterm elections.

A 12-person jury could unanimously agree that there is a 75 percent possibility that the defendant is guilty of the crime charged - and that jury could still decide unanimously to acquit because the panelists think prosecutors have not proven the defendant's guilt beyond a reasonable doubt, Lee said.

Kavanaugh took his seat at the end of the bench to Roberts' far left, a visible manifestation of a moment that Republicans have dreamed of for decades, with five solidly conservative justices on the court, and Democrats have dreaded.

"For as long as Kavanaugh sits on the court, he will remain a symbol of partisan anger, a haunting reminder that behind the smiling face of judicial benevolence lies the force of an urgent will to power", Yale law professor Robert Post wrote in Politico.

"What was done last night in the White House was a political rather". Last year, the Senate confirmed Justice Neil Gorsuch. "I've worked hard throughout my career to promote the advancement of women", he said. Kavanaugh will also reunite with six of his former clerks on the US Circuit Court of Appeals for the District of Columbia who are now clerking for other justices. McConnell called the current partisan divide a "low point", but he blamed Democrats. But when asked again Sunday about it, he said different rules might apply if the same party controls the Senate and White House. The victory is a boon for Republicans who are looking to hold on to majorities in the house and Senate.
